David Avellar Neblett 
David
Avellar Neblett, Esq., is a founding partner of Perry Neblett P.A. In
addition to Perry & Neblett P. A., Mr. Neblett has worked for or associated
with a number of other renowned law firms including Lipcon, Margulies
& Alsina, P.A., The Law Offices of Laurence Edward Zieper P. A. Miami
Maritime Law and Gaebe, Mullen, Antonelli, Esco, & DiMatteo, P.A.
Prior to starting his own firm and focusing on first party insurance and
admiralty litigation, Mr. Neblett worked for an insurance defense firm
where he represented insurers in all types of land and sea based property
and personal injury claims.
David
Avellar Neblett earned a degree in the Marine Sciences from the University
of Miami, and a J. D. in law from the University of Miami School of Law
with special emphasis in Admiralty and Insurance law. Mr. Neblett was
the Admiral of the Maritime Law Society for two years, the Vice President
of the Environmental Law Society for one year. Mr. Neblett is very active
in the legal community via his active participation and lecturing with
many national and local organizations and through his studies and work
at the University of Miami School of Law, and RSMAS "University of
Miami’s Marine Science Graduate School."
Mr. Neblett is a member of the Maritime Law Association of the United
States, the Maritime Law Society, the Marine Council, the Southeastern
Admiralty Law Institute, the Dade County Bar, the Coral Gables Bar, the
Florida Bar, the Marine Industries Association of South Florida, the Propeller
Club, the Nature Conservancy, Earth Justice, and the Sierra Club. David
Neblett is also very active with the insurance Bar and is a member of
F.A.P.I.A., the Florida Association of Public Insurance Adjusters.
David
Neblett partnered with James Perry so that he could focus on Admiralty
litigation, first party insurance claims and trial work. Mr. Perry is
a quintessential Admiralty attorney who has been perfecting his craft
and focus on vessel transactions and maritime litigation since he became
an attorney in 1993. Mr. Neblett runs the firm's litigation and first
party insurance sections. David Neblett actively litigates cases and/or
handles trials in both state and federal Court. Many firms use Mr. Neblett
to handle all of their first party insurance and maritime work. Other
firms rely on Mr. Neblett to litigate cases for them. These "of counsel"
positions expands Mr. Neblett’s practice areas to all types of insurance
and personal injury cases and has given him the opportunity to refine
his trial and litigation skills. Combining forces with these referral
firms has also increased the geographic reach of Perry Neblett P.A. as
all attorneys and experts have use of offices located in Miami, Ft. Lauderdale,
Orlando, and West Palm Beach.
David Avellar Neblett has represented a number of insured's in all types
of property loss claims from commercial property claims valued in the
tens of millions of dollars to residential hurricane claims. Mr. Neblett
also represents vessel owners with their insurance claims, parties in
recreational boating accidents, groundings, and reef and mangrove destruction.
Mr. Neblett is an avid, fisherman, Scuba diver and sailor and has worked
on cases involving persons injured or killed on boats and in diving accidents.
David Neblett has represented yacht owners regarding vessel sales and
cases dealing with vessel "Lemon Law" and contractual claims.
Mr. Neblett is experienced with both Jones Act and Longshoremen claims,
and has handed claims involving all types of seamen, from stone crab fishermen
to waiters aboard cruise ships. David Neblett is one of the few if not
the only attorney in Florida who has developed the specialty of boating
under the influence defense and has been very successful in getting his
clients out of criminal convictions for this issue as well as other boating
citations. Mr. Neblett also handles claims regarding passengers and crew
that are injured aboard cruise ships, and other vessels including gambling
ships, and fishing charters.
Hurricanes and named storms have caused significant problems and countless
millions in damages to everyone in Florida including many maritime industries
and vessels owners. This loss and destruction to commercial property,
condominiums, vessels, marinas, docks and homes has allowed David Neblett
to use his background in insurance defense to assist insured's with their
claims and to fight for coverage and/or reasonable values for these losses.
David Avellar Neblett was instrumental in the reduction of "salvage"
costs and charges from damages from hurricane Wilma to the 18 houseboats
that sunk at Gator Harbor West and the vessel owners at Sunny Marina.
He has assisted these clients and many others with maritime and non maritime
insurance claims and disputes.
David Avellar Neblett has also worked for and against many state and
federal agencies regarding damages to natural resources and natural resource
management. The State of Florida and the various parks and recreational
areas have begun to vigorously enforce damages to natural resources by
both recreational boaters and commercial vessels alike. Thus, vessel groundings,
sea grass and mangrove damage, and small point site pollution have become
actively litigated issues that can result in fines and penalties resulting
in the tens of thousands of dollars. Mr. Neblett has been able to use
his marine science background and alliances to mitigate damages and fines
assessments to save money for those charged while at the same time protecting
the environment by implementing conservation and remidiational projects
that are not only more cost effective, but also have a higher documented
success rate.
Mr.
Neblett is admitted to practice law in Florida State Courts, the Southern,
Middle, and Northern Districts of the United States District Courts of
Florida, and is also admitted to litigate in South Carolina and in the
Eleventh Circuit Court of Appeals.
